1. About these Terms
These Terms govern your use of scentieri.com and any orders you place through it. The Site is operated by SH S.r.l. By using the Site or placing an order, you accept these Terms. If you do not accept them, please do not use the Site.
2. Who can use the Site
To purchase from the Site, you must be at least 18 years of age and have the legal capacity to enter into binding contracts.
3. Products and information
We make reasonable efforts to display products, ingredients, and pricing accurately. However, we do not guarantee that all product descriptions, photographs, or other content are entirely free of errors. Colors of products may appear slightly different on screen depending on your device.
Our products are cosmetics intended for external use only. Please read the ingredient list before use, particularly if you have known allergies or sensitivities. If irritation occurs, discontinue use and consult a doctor if symptoms persist.
4. Pricing and payment
Prices are displayed in Euros (EUR) and include applicable VAT for EU destinations. Shipping costs, where applicable, are calculated and displayed at checkout before payment.
We accept payment via the methods displayed at checkout. Payment is captured when the order is placed.
Pricing errors: in the rare event of an obvious pricing error, we reserve the right to cancel orders placed at the incorrect price and issue a full refund. This does not affect your statutory consumer rights.
5. Order acceptance
The display of products on the Site is an invitation to treat, not a binding offer. Your order constitutes an offer to purchase. We reserve the right to refuse or cancel any order at our reasonable discretion, including in cases of suspected fraud, payment failure, inventory unavailability, or shipping restrictions. A binding contract is formed only when we dispatch your goods. If we cancel before dispatch, we will refund your payment in full.
Order confirmation will be sent to you by email and remains accessible on the Site under your account.
6. Shipping and delivery
Shipping terms, costs, and estimated delivery times are described in our Shipping Policy, which forms part of these Terms.
If we have not dispatched the goods within the estimated time, you may set a reasonable additional period for delivery. If that period also expires without dispatch, you have the right to cancel the contract and receive a full refund.
7. Right of withdrawal and returns
Your right to withdraw from the contract and return goods is described in our Return and Refund Policy, which forms part of these Terms. The right of withdrawal does not apply to sealed cosmetic products that have been unsealed after delivery.
8. Statutory consumer warranty
Goods purchased through the Site are covered by the 2-year legal guarantee of conformity under EU consumer law. If a product is found to be non-conforming within this period, you may request repair, replacement, a price reduction, or termination of the contract.
9. Intellectual property
All content on the Site, including the Scentieri name, the Scentieri "S" logo, the "PATHS OF SCENT" tagline, "PINE SERENITY" product line name, all photographs, illustrations, copy, and design, is the exclusive property of SH S.r.l. or its licensors. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent, except for personal, non-commercial use of the Site as intended.
10. User content
If you submit content to the Site (such as product reviews, photographs, or feedback), you grant SH S.r.l. a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You confirm that any content you submit does not infringe the rights of any third party and is not unlawful, defamatory, or obscene.
11. Limitation of liability
To the extent permitted by law, SH S.r.l.'s liability arising from the use of the Site or the purchase of products is limited to the value of the relevant order. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits any liability that cannot lawfully be limited under applicable consumer law.
12. Force majeure
We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, government actions, strikes, supply-chain disruptions, carrier failures, or epidemics. If a force majeure event prevents performance for more than 30 days, either party may cancel the affected order and we will refund any payment made.
13. Privacy and cookies
The processing of your personal data is governed by our Privacy Policy. Information on the cookies and tracking technologies used on the Site is described in our Cookie Policy.
14. Governing law, language, and jurisdiction
These Terms are governed by Italian law. The UN Convention on Contracts for the International Sale of Goods (CISG, 1980) does not apply. For consumers domiciled in the EU, the mandatory protections of your country of residence apply where they provide greater protection than Italian law. Any dispute arising in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the Court of Bolzano, Italy, unless the law of your country of residence reserves jurisdiction to the consumer's local courts.
These Terms are published in English, Italian, and German. The Italian version is the only legally binding version; English and German versions are provided for convenience only. In case of discrepancy between language versions, the Italian version prevails.
15. Online Dispute Resolution
Consumer disputes may be referred to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force. The invalid provision is replaced by the valid provision that most closely reflects the original intent.
17. Assignment
You may not assign or transfer your rights or obligations under these Terms to a third party without our prior written consent.
18. Changes to these Terms
We update these Terms when our practices change or when required by law. The version in force at the time of your purchase governs that purchase. Material changes will be notified on the Site.
